If the real estate property is a matrimonial home, then you MUST get consent from the other spouse. Under the Family Law Act, neither spouse can dispose of or hinder interest in selling the property. If a matrimonial home is transferred without the appropriate consent, the transaction may be set aside by a court. These rights apply even if the matrimonial home is registered in the name of one spouse only unless the marriage ends by either death or divorce then the right will too. First-time homebuyers in Ontario can qualify for the Land Transfer Tax Rebate to the total amount of their land transfer tax up to a maximum of $4,000.00. You must meet the following criteria to determine whether you are qualified as a first-time homebuyer or not.
