An Agreement of Purchase and Sale (APS) is a legally binding contract between the seller and buyer that is used in real estate transactions. It is important to review and understand the terms of the APS to avoid agreeing to additional fees, deadlines, and damages in the contract. After receiving your Agreement of Purchase and Sale (APS), a TR Law Clerk will contact you to fill the client intake form. As a purchaser, you are responsible to provide:

– A mortgage statement (showing a balancing outstanding in the same amount as the statement of adjustments)

– Provide a copy of the mortgage

– Particulars of the mortgage number and address payment

If the real estate property is a matrimonial home, then you MUST get consent from the other spouse. Under the Family Law Act, neither spouse can dispose of or hinder interest in selling the property. If a matrimonial home is transferred without the appropriate consent, the transaction may be set aside by a court. First-time homebuyers in Ontario can qualify for the Land Transfer Tax Rebate to the total amount of their land transfer tax up to a maximum of $4,000.00. You must meet the following criteria to determine whether you are qualified as a first-time homebuyer or not.

– You must be a Canadian citizen or permanent resident of Canada

– You must be the age of 18 years or older

– You must live in the home within 9 months of purchasing it

– You must be a First-time Home Buyer (cannot own a home from before)

– Your spouse cannot have owned a home during the time they have been with you
